1 Subject of the conditions of participation and organizer
1.1 The organizer of the “raffle” is playconda GmbH (hereinafter referred to as “playconda”).

1.2 These conditions of participation regulate the conditions for participation in the playconda “raffle” as well as any necessary transfer of rights.
1.3 The competition is not connected to Facebook, Instagram, Twitter, Reddit or any other social media platform. It is neither sponsored, supported nor organized by Facebook, Instagram, Twitter, Reddit or any other social media platform. The aforementioned social media platforms are also not available as contact persons for the sweepstakes.
2 Participation
2.1 All natural persons who have reached the age of 18 are eligible to participate. Employees of playconda, its affiliated companies and relatives of employees are excluded. Participation with fake identities, with identities of third parties or with multiple identities is not permitted.
2.2 Participation in the sweepstakes is free of charge and independent of the purchase of goods and services.
3 Duration of the sweepstake
3.1 The “raffle” will take place in the period from 12.01.2021 to 20.01.2021 CET (Central European Time).
4 Prizes and notification of prizes
4.1 Among all eligible participants, playconda will draw an in-app reward.
4.2 The winner will be determined at random from all eligible participants on 21.01.2021 (CET) and published. If the winner does not respond within 72 h, playconda reserves the right to award the prize to someone else. The previous winner loses the claim for the prize.
4.3 Only one prize is possible per participant.
4.4 The prize is not transferable, nor can the prize be exchanged or paid out in cash.
4.5 If circumstances arise for which playconda is not responsible, the winner will accept an appropriate replacement prize.
4.6 The in-app reward will be sent to the player ID within our mobile game Idle Lemonade Tycoon the winner sends us via direct message after the draw. If playconda does not receive the necessary Player-ID within the 72h, the player has no right to the prize.
5 Execution of the lottery (game procedure)
5.1 In order to participate in the prize draw, participants must like the prize draw posting (“Like” or similar on the specific platforms) and post a comment below the post.
6 Granting of rights of use
6.1 Each participant of the competition agrees that in the event of winning, he or she will be published anonymously with his or her first or last name as well as the prize on Facebook, Instagram, Twitter, Reddit or any other social media platform and the website of playconda.
7 Liability and indemnification
7.1 playconda shall not be liable for technical malfunctions related to the prize draw as well as for non-availability of the prize draw.
7.2 playconda is not responsible for posts and content published by users of Facebook, Instagram, Twitter, Reddit or any other social media platform. This includes, for example, trademark, copyright and competition violations as well as insults by users. Each participant guarantees to observe applicable law and the rights of third parties.
7.3 The participant indemnifies playconda against claims of third parties of any kind whatsoever resulting from the illegality of texts, photos or other content used by the participant. The indemnification obligation also includes the obligation to fully indemnify playconda from legal defense costs (e.g. court and attorney fees).
7.4 By participating in the competition, the participant releases Facebook, Instagram, Twitter, Reddit or any other social media platform from any liability.
8 Exclusion of participants
8.1 A violation of these conditions of participation entitles playconda to exclude the respective participant from participation. This applies in particular if the participant makes false statements or violates applicable law or the rights of third parties with photos used or other content (e.g. comments). The same applies to comments that glorify violence, are offensive, harassing or derogatory or otherwise offend the sense of decency of all fair and just thinkers.
8.2 If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.
9 Premature termination and changes
9.1 playconda reserves the right to prematurely terminate the sweepstakes in whole or in part at any time, even without observing deadlines, or to modify its course if it is not possible to ensure proper implementation of the sweepstakes for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook, Instagram, Twitter, Reddit or any other social media platform).
10 Data protection
10.1 Responsible for the collection, processing and use of personal data of all participants is playconda GmbH. playconda processes the data required from the participation fields (Username on the social media platform and Player-ID) for the implementation, processing of the competition and notification and transmission of the prize. The personal data collected for the competition will be deleted within 30 days after the winners have been drawn. In all other respects, the data protection declaration of playconda applies, available at https://playconda.com/privacy-policy.
The legal basis for the aforementioned data processing is Art. 6 para. 1 b) DSGVO.
11 Final provisions
11.1 German law shall apply.
11.2 Legal recourse is excluded.
11.3 Should individual provisions of these competition conditions be invalid or unenforceable, this shall not affect the validity of the remaining provisions. In this case, instead of the invalid or unenforceable terms and conditions, such terms and conditions shall be deemed to have been agreed which come as close as possible to the purpose of the invalid or unenforceable provision.
